        North Dakota Victims Rights

Under North Dakota law (North Dakota Century Code 12.1-34 ), victims and witnesses of crime must be afforded the following rights where applicable:

·         Informed as to status of investigation.

·         Informed as to criminal charges filed.

·         Notice of pretrial release.

·         Notice as to victims' and witnesses' participation in court proceedings.

·         Services available.

·         Employer intercession.

·         Witness Fees.

·         Return of property taken as evidence.

·         Waiting area separate from the defendant.

·         Right to be present throughout the trial.

·         Prompt disposition of the case.

·         Notice as to scheduling and cancellations of hearings.

·         Victim impact statement.

·         Notice of final disposition and parole proceedings.

·         Prompt notice of custodial release.

·         Participation in parole board and pardon hearings.

Victims and witnesses of crimes committed by juveniles are entitled to the same rights under the law in juvenile delinquency proceedings as in any other proceeding.   This does not apply in federal court.

Children's Rights Under North Dakota Law

In addition to all rights afforded to victims and witnesses by law, States Attorney's are encouraged to provide the following additional services to children who are involved in criminal proceedings as victims or witnesses: (North Dakota Century Code 12.1-35)

·         Explanation, in language understood by the child, of all legal proceedings in which the child will be involved.

·         Advice to the court concerning the ability of a child witness to cooperate with the prosecution and the potential effects of the proceeding on the child.

·         Information about, and referrals to appropriate social service programs to assist the child and the child's family members in coping with the emotional impact of the crime and the subsequent proceedings in which the child is involved.

·         Information about the availability of a child development specialist to ensure questions asked of the witness are chronologically and developmentally appropriate.
